Court
U.S. Court of Appeals for the Ninth Circuit
Decided
Citation
649 F.3d 986 (9th Cir. 2011) (en banc)
Topics
Miranda & Police Questioning

What did the court decide?

The full Ninth Circuit held that a 17-year-old's confession, given after a lengthy overnight interrogation in an Arizona murder investigation, was obtained in violation of Miranda because the warnings were confusing and played down, and that the confession was involuntary. Federal habeas relief was granted.

Why does it matter?

How warnings are given matters, not just whether they were read. Age and the length of questioning are part of the picture.
